The lender must file for a lawsuit against the borrower when there is no power of sale.  The property is then auctioned off after the following procedure is followed.  The lender must first advertise the notice of sale for three consecutive weeks in newsprint within the county of where the property is located.  The finale publication cannot be no more then 14 days and no less then seven days before the sale date.  The borrower must receive notice of the sale as well as all who have lien within five days of the first public posting.  </p>
<p>Generally, the borrower has a year from the date of the sale to redeem the property.  Kansas does allow for lenders to sue for a deficiency judgment for the loss between the foreclosure sale and the original amount due on the mortgage.  </p>
